This Privacy Policy (“Privacy Policy”) designed to explain how SportsMD Media Inc. (hereafter, individually and collectively, “we”, “us” or “the Company”) is committed to respecting the privacy rights of all users of the Companies services provided the sportsmd.com (collectively, “site”) and to protecting your personal and medical information. This policy describes how information about you may be used, how it may be disclosed and how you may access this information.
This page will serve as a policy of our privacy practices and a summary of your privacy rights.

We created this Site Privacy Policy (“Privacy Policy”) to give you confidence as you visit and use the Site, and to demonstrate our commitment to fair information practices and the protection of privacy. This Privacy Policy is only applicable to the Site, and not to any other websites that you may be able to access from the Site or any website of the Companies partners, each of which may have data collection, storage, and use practices and policies that differ materially from this Privacy Policy. Your use of the Site is governed by this Privacy Policy and the Terms of Use . If you are registering an account or using the Site on behalf of an individual or entity other than yourself, you represent that you are authorized by such individual or entity to accept this Privacy Policy on such individual’s or entity’s behalf.

Please note our primary concern is to provide a platform for quick and simple online consultation. Be advised, in case your medical question or consultation contains matters of high security risk or there is a high privacy concern (like matter of Federal or State importance, matters related to judiciary, matters related to police or law enforcement) we suggest you to use alternate services or to use face to face medical consultations. It is advisable to include only relevant de-identifiable Personal Information in medical history and files uploaded by you.

If you do not agree to terms of our Privacy Policy we kindly request you to not use this site.

Information Collection and Use

We collect personal and non-personal information to customize the content and services. We ask you to enter an e-mail address and password, which we refer to as your Site ID. After you create your ID, you can use the same ID to sign in to this service. This process will allow you to manage your profile and/or account; upload files (medical scans and documents) and ask specific queries.

When asking questions, you will be asked to submit personal information like age, gender and medical history (option but recommended). Providing us with other personal and identifiable information is, of course, optional and not recommended.
However, in some cases it may not be possible for us to provide the service in question without receiving specific medical information from you and in some cases you would be requested by the consulting Physician to provide additional information in order to answer your questions. Additional information could be details of your medical history, specific medical reports etc.

We automatically track and collect IP addresses, domain servers, type of web browsers, computers and domain servers used to access the site, referring source to the site and your interaction with the site and the browser, (Collectively “Traffic data”).

We also collect information you provide voluntarily in free-form text boxes on the Site and through responses to surveys, questionnaires and the like.

Information you provide may also be handled by third party service providers such as hosting services that are bound by similar privacy restrictions.

Information You Provide

You may be asked to provide personal information in certain fields on the Services. We collect personal information when you voluntarily provide it to us or when you authorize us to collect it on your behalf. The following personal information may become available to the Company when accessing or using the Services: First and last name Company, home, postal or other physical address, Other contact information, including your telephone number, email address, other online contact information, such as an instant messaging user identifier or a screen name that reveals an individual’s email address, a persistent identifier, such as a customer number held in a cookie or processor serial number, that is combined with other available data that identifies an individual, account information (user name and password), and any other information from or about an individual that is combined with any of the above: Personal health information, Date of birth, Transaction-related information, including, credit card or other preferred means of payment, billing or shipping information, or a history of services purchased.

Any other information needed to provide you with a service that you have requested. Examples of scenarios where our visitors and subscribers provide their personal information include, but may not be limited, to:

Emailing, calling, accessing, using or communicating with the Company or the Services, Posting a question or comment through the Services Registering, Transactions, Customer service, Participating in an online survey, Requesting inclusion in an email or other mailing list Invitations, Logging in to the Services, thus requiring a user name and/or a password, Any other business-related reason. The Company will allow you to either agree or decline to give your personal information via the Internet. The Company will inform you of the purpose for the collection and the Company does not intend to transfer your personal information to third parties without your consent, except under the limited conditions described below. If you choose to provide us with your personal information, the Company may communicate with you at the contact information you have provided and we may transfer that information, within the Company or to a third party service provider as necessary.

Domain Information Collection the Company may collect domain information to enable us to analyze how our visitors use our Services. This data enables us to become more familiar with which people visit our Services, how often they visit, and what parts of the Services they visit most often. the Company uses this information to improve its Web-based offerings. This information is collected automatically and requires no action on your part. Our Web advertising partners may use your IP address to determine your approximate geographic location in order to provide you with location-relevant advertising.

How information about you may be used by the Company 

Personal information like your medical history (optional), gender and age details is collected when you start a new consultation request. These are saved in your account for future reference and future consultation requests.

These details in conjunction with your questions are shared with Consulting Physicians to help them answer your questions to the best of their knowledge.

Once the consultation is complete, we may share your questions (without any personal information) and respective answers by Physicians on site, to enable site visitors to learn from your medical experiences.

We may also use your de-identified Personal Information to run (or authorize third parties to run) statistical research on individual or aggregate health or medical trends. Such research would only use your Personal Information in an anonymous manner that cannot be tied directly back to you.

Non medical information, primarily your email will be used to:

  • Provide to you the services offered by the Site.
  • Troubleshoot problems, Provide you with system or administrative messages, and as otherwise described to you at the time of collection.
  • Payment notifications: Bill any amounts due from you through our affiliate merchants.
  • Deliver information to you that is relevant to your interests, such as notifications and reminders related to consultation.
  • Recommend certain resources or medical providers, inform you about our product and services.
  • Customize and improve your experience.
  • Detect and protect us against error, fraud and other criminal activity.
  • Enforce our Terms of Use.

However, in other instances, non-personal information collected may be used for statistical analysis, improvement of services, and customization of web design, content layout and services.

Special Note for Parents

The Services are a general audience Services and not designed or intended to attract children younger than 13. We do not collect personal information from any person we actually know is younger than 13, without parental or such person’s legal guardian’s consent. Provided that, such parent or guardian is solely responsible for providing supervision of the minor’s use of the Services. The parent or guardian assumes full responsibility for ensuring that the minor’s information is kept secure and that the information submitted is accurate. The parent or guardian also assumes full responsibility for the interpretation and use of any information or suggestions provided through the Services for the minor.

Sharing of information 

We do not sell or rent your personal information to third parties. We do not share your information with third parties for purposes other than that of providing you the services as mentioned in point 8 in this Privacy Policy document.

  • You may choose to authorize the Company to share your Personal Information like Medical History with our Physicians.
  • In order to customize your advertising interactions, we may share Personal Information with advertisers and other third parties only on an aggregate (i.e., non-personally-identifiable) basis.
  • We may share your de-identified Personal Information with third parties to enable them to run statistical research on individual or aggregate health or medical trends.
  • We share Personal Information and Traffic Data with our business partners who assist us by performing core services (such as Consultations, maintenance of site, hosting, billing, fulfillment, or data storage and security) related to our operation of the Site and/or by making certain Interactive Tools available to our users. Those business partners shall be bound to uphold the same standards of security and confidentiality that we have promised to you in this Privacy Policy, and they will only use your Contact Data and other Personal Information to carry out their specific business obligations to the Company and to provide your requested medical care and services.
  • We may transfer information about you to another company in connection with a merger, sale or acquisition by or of the Company. In this event, we will use reasonable efforts to notify you before information about you is transferred and becomes subject to a different privacy policy.

Use of Cookies and Tracking User Traffic

Some pages on the Services may use “cookies”—small files that the Services place on your hard drive for identification purposes. A cookie file can contain information such as a user ID to track the pages visited, but the only personal information a cookie can contain is information you supply yourself. These files are used for Services registration and customization the next time you visit us. Some parts of the Services may also use cookies to track user traffic patterns. The Company does this in order to determine the usefulness of our Services information to our users and to see how effective our navigational structure is in helping users reach that information. Please note that cookies cannot read data off of your hard drive. Your Web browser may allow you to be notified when you are receiving a cookie, giving you the choice to accept it or not. Web Beacons

We also use Web beacons, sometimes called single-pixel GIFs, that momentarily direct your browser to a server other than the Company in a way that may not be apparent to you. Web beacons are used to count users who visited specific pages and determine which emails were opened and/or acted upon when we send HTML-formatted email messages. We do not link any identifying information to Web beacons.

Information That We Obtain From Third Parties

We will use third party information, combined with information you provide to us and information collected by our systems, to better understand the characteristics of the visitors to and uses of our Services and to develop new products, services and content areas. This information will also allow us to tailor content, advertising and offers to your specific interests and needs.

We know how important it is to keep the information you have entrusted to us confidential. We will not share personal information about you with third parties except to provide you with a product or service you request or under certain circumstances as described herein. Agents and Contractors

Depending on the circumstances, we may or may not charge third parties for this aggregated information. We also may not limit the third parties’ use of the aggregated information.

The Services feature community areas such as message boards, blogs, chat rooms and other public forums where people with similar interests can share information or where users can post questions for experts to answer, which includes, online discussions moderated by medical, healthcare and sport experts (all of the foregoing, individually and collectively “Public Areas”). Please remember that any information that you post in Public Areas is, by design, open to the public and is not a private, secure service. You should think carefully before disclosing any personally identifiable or personal health information in any Public Areas. What you have written and or posted may be seen, disclosed to or collected by third parties and may be used by others in ways we are unable to control or predict, including to contact you for unauthorized purposes. As with any public forum on any Web site, this information may also appear in third-party search engines like Google, Yahoo, Bing etc.

Co-Branding

Some products or services may be co-branded and offered in conjunction with another company. If you register for or use such products or services, both the Company and the other company may receive the information collected in conjunction with the co-branded product or services. Please refer to that company’s privacy policy to determine how that company may use this Information.

The Services may contain links to other Web sites. the Company does not share your personal information with those Web sites, except as set forth herein, and is not responsible for their privacy practices. We encourage you to learn about the privacy policies of those Web sites. This Privacy Policy applies solely to information collected by or provided to the Company

Confidentiality and Security

The Company has implemented reasonable security measures in order to protect both personal and non-personal information from loss, misuse and unauthorized access, disclosure, alteration or destruction. You make the choice of making your data available to consulting doctors. We follow generally accepted industry standards to protect the Personal Information. For example we use multiple layers of firewall security and different degree of encryption for your sensitive personal data. We are not guided by HIPAA compliance right now, but have plans to enforce it within our policy as our service expands.

Our employees and consulting physicians may share medical information with each other for treatment, payment and operational purposes, only in order to provide efficient healthcare services. We encourage users not to share non-medical identifiable information other than their email and at times a made-up username for public forums.

Your personal data may in some situations be seen by third parties, such as doctors or operations and maintenance contractors repairing and maintaining our technical systems. The respective contracts require businesses to protect the medical information we share with them. The Company will use the information received to provide our services in the best interest of the Company.

In support of Health initiatives, we may use and share your medical information for research. We will only use and share information for research after obtaining your consent or if the used data does not expressly identify you in any way.

We will share your medical information when required to comply with court order or other legal process. We may use and share your medical information to protect the rights, property or safety of the Company or another party, or to respond to claims that any posting or other content violates the rights of third-parties.

The Site may contain links to other sites. Please observe that we are not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements these websites.

We might send notifications, reminders and health information to the email ids provided by you. The Company will not be responsible for the information loss or privacy loss due to the incorrect email id provided by you.

Although we make good faith efforts to receive, transmit and store Personal Information in a secure operating environment that is not open to the public, you should understand that there is no such thing as complete security, and we do not guarantee that there will be no unintended disclosures of your Personal Information. If we become aware that your Personal Information has been disclosed in a manner not in accordance with this Privacy Policy, we will use reasonable efforts to notify you of the nature and extent of the disclosure (to the extent we know that information) as soon as reasonably possible and as permitted by law.

Doctors and Providers

Doctors and their employees should be particularly aware of their obligations of patient confidentiality, both in communicating with the Company and in consulting users via the site. The Company does not have, and will not accept, any obligations of confidentiality with respect to any communications other than those expressly stated in this Privacy Policy and the Companies Terms of Use.

Secure Payment

When you place orders on our Services, all of your order information, including your card number and delivery address, is transmitted through the Internet using Secure Sockets Layer (“SSL”) technology. SSL technology causes your browser to encrypt your order information before transmitting it. SSL technology, an industry standard, is designed to prevent someone other than operators of our Services from capturing and viewing your personal information. Since any order information you provide to us on our Services will be transmitted using a secure connection, if your Web browser cannot support this level of security, you will not be able to order products through our Services.
